Workers' Compensation

Injured at Work in Oklahoma? We'll Help You Navigate What Comes Next.

A workplace injury can turn your life upside down. You’re hurt, the bills are piling up, and you’re not sure what steps to take or who’s really looking out for you. That’s where we come in.

At Brian Williams Law, we help injured workers across Oklahoma get the compensation they’re entitled to. Whether you need to file a workers’ compensation claim, pursue additional damages through a personal injury lawsuit, or just want honest answers about your options, our team is here to guide you.

Workers’ Compensation What You Need to Know

Most employers in Oklahoma are required to carry workers’ compensation insurance. If you were hurt on the job or developed a work-related illness, you likely qualify for benefits. But getting those benefits is not always simple.

Here’s what you should do right away:

  1. Report your injury to your employer as soon as possible

  2. Get medical attention In an emergency, go to any doctor, but expect to see a physician approved by your employer’s workers’ comp insurance later

  3. Call an attorney You don’t have to go through this process alone

We can help you file your claim, avoid costly delays or mistakes, and push back if your employer or the insurance company tries to deny your benefits.

What Does Workers’ Comp Cover?

If your claim is approved, workers’ compensation should cover:

  • All necessary medical treatment related to your injury

  • Lost wages through temporary total disability payments while you’re unable to work

  • Partial disability benefits if you can return to work but in a limited capacity

  • Permanent disability compensation if your injury results in long-term impairment

Workers’ comp is a no-fault system which means you can still qualify even if the accident was partially your fault so long as it wasn’t caused by willful misconduct.

Can You Sue After a Workplace Injury in Oklahoma?

In most cases, you can’t sue your employer directly if they carry proper workers’ compensation insurance. But there are important exceptions including:

  • Your employer intentionally caused your injury

  • Your employer doesn’t have workers’ comp coverage as required by law

You may also have the right to file a third-party personal injury claim if someone outside your workplace caused or contributed to your injury. For example, if you were injured by a defective machine, a negligent driver, or a subcontractor on a job site, you could seek additional compensation.

Unlike workers’ comp, a third-party injury claim can include damages for:

  • Pain and suffering

  • Emotional distress

  • Future lost earnings

  • Loss of quality of life

We’ll help you determine whether a civil claim is an option in your case and if so pursue both paths in a coordinated way to maximize your total recovery.

Why Timing Matters

Workplace injury claims are time sensitive. You have limited windows to report the injury, file paperwork, and take legal action. Waiting too long could affect your benefits or your right to sue.

The sooner you reach out, the more options we’ll have and the stronger your case will be. Our team can take the pressure off your shoulders and make sure nothing falls through the cracks.
